Facing a Divorce can be one of the most challenging times in a person’s life. You may not know where to turn, what to do, or whom to trust. The decisions you make during this time will have a lasting impact on your future. What’s more, the Divorce process can be much more complicated if it is a contested Divorce in Singapore.

Uncontested Divorces are encouraged by the judicial system in Singapore as an alternative to a contested Divorce in Singapore. An uncontested Divorce in Singapore allows for an immediate Divorce without going through the Court for a Divorce proceeding.

It only requires the filing of Divorce documents in Court. Within one month after filing for Divorce, both parties can expect the Court to issue an interim Divorce order. Three months later, the Court issued a certificate making the Divorce final.

What Is A Contested Divorce?

In Singapore, if a Divorce is contested, both parties disagree on the matters and want to file for their claims. These issues must be resolved before the Divorce can be finalised.

Proceedings for a contested Divorce in Singapore will usually occur in an open court hearing. The couple will have to present evidence to support their respective claims regarding resolving that matter. Members of the public are also allowed to attend the hearing.

What Is An Uncontested Divorce?

A simplified or uncontested Divorce in Singapore means that both spouses agree to a Divorce and all ancillary matters such as custody of children, child maintenance/spousal maintenance and division of assets.

Both parties must agree on the Divorce and its terms before filing the Divorce documents to their respective lawyers. Once your lawyer has filed the papers for a simplified Divorce hearing (both parties are not required to be in attendance) in the Family Court, the Divorce proceedings will take place.

Uncontested Divorce proceedings may occur in a private domain that is not open to the public, unlike contested Divorce proceedings. Also, uncontested Divorce proceedings are usually shorter and cost less than a contested Divorce in Singapore.

What’s The Advantage Of An Uncontested Divorce Over A Contested Divorce?

When people think of Divorce, many usually envision a nasty battle in court when dividing property, money and rights over the children. However, what they may not know is that most Divorces can be resolved on an uncontested basis where the parties can amicably settle their differences without even going to a trial. In contrast, a contested Divorce tends to be more stressful, take much longer to complete and also cost more due to legal fees.

In an uncontested Divorce, you and your spouse will reach a mutual agreement on issues such as maintenance of  the wife and children, child custody and access rights as well as division. The court also doesn’t get involved because you’ve managed to settle all your issues without costly litigation. That’s why uncontested Divorces usually save more time and money as compared to contested Divorces.

A contested Divorce takes place when you and your spouse are unable to reach an agreement on issues even after trying to discuss, negotiate or mediate. If this happens, the Divorce case will be handled by the Court which will make the final decision on the issues and terms of the Divorce.

Although you can try to handle an uncontested Divorce without engaging a lawyer, it is prudent to engage a lawyer to guide you through a contested Divorce because it usually involves more complex issues and technical legal procedures and rules.
