WHAT’S THE DIFFERENCE BETWEEN A PRENUPTIAL AND A POSTNUPTIAL AGREEMENT?

If you’re planning on getting married and foresee possible future disputes regarding the handling of property division, maintenance payments for the wife and children, child custody and access rights in the unlikely event of a divorce, you can consider getting a prenuptial agreement signed before the marriage – this will contain the mutually agreed terms between you and your spouse on how to handle the ancillary matters ahead of time as a matter of prudence and will help to eliminate or at least reduce the likelihood of such disputes taking place subsequently. Sometimes, issues come up through the course of the marriage after the wedding and an agreement made at that time (during the marriage) to handle the same issues is considered a postnuptial agreement.
